The rider is the one named in the official sanction and the one that takes the consequences. But, of course, he would have no idea what ECU or software is in his bike unless it feels appreciably different to him at the controls. I am sure the team will still pay him for his points and apologise to him. They will all be gutted.

Or any other items on the bike that he/she hasn't personally fitted to the bike ?

If not, then why should the rider be named as "you were found to using…"
I reckon the team should be mmade to pay the rider a penalty fee to compensate them for
being personally named as the responsible one.
